| Federal Student Loan Collections Hello, I'm new to the forum, though I am familiar with some of you. I have a question about Fed. Student Loan Collections Department...does their "Default Resolution Group" (their collections department) fall under the same rules of the FDCPA? I sent certified mailing with return receipt, a VOD/DCDS to "their" collections department and I received a letter stating that "their department is Exempt from the FDCPA, 15 USC 1692. I thought I had read at suijuris forum a post by sharing lights stating that they fall under the same rules as other collection agencies. I hope this is the case. Regardless, and just in case, I have mailed out a second VOD/DCDS on 1/7/08. Before it had went into collections I had mailed them a request for VOD. I requested 1-validation of the debt (the actual accounting), 2-verification of the claim against me (a sworn affidavit), and 3-a certified copy of the contract with signatures of both parties that bind this contract. I NEVER received requests 2 and 3, not so sure about the first one, they sent me some statements. I then mailed them an Affidavit of Default. They mailed me a response stating that neither my comments nor documents altered my obligation to repay the loan! Imagine that! One can not request proof?! If anyone has any info or advice I'd surely be glad to receive it. I thank you! |
