| Child support and Constitution This case is a prime reason WHY you must know what you are doing when you go to court. In this particular case, a Mr. Foss from New Hampshire tried to argue that child support was payable in only gold or silver coin per the constitution. First of all, court was the last place he was suppose to be to get his remedy, but, let me point out how a manuever the court did to skirt around the issue. They pointed to case law from other states that said congress created federal reserve notes as legal tender and that states are thus, not precluded for using them as legal tender. What they failed to mention is congress can only COIN MONEY, not print money. Just because congress authorized federal reserve notes doesnt mean their action is constitutional. THIS IS PRECISELY the reason they passed hjr 192 so that they couldnt be tried for treason. Anyway, i attached the case so that you guys could study a likely manuever the court will try to foist upon you. If mr. foss had tendered a negotiable instrument INSTEAD of arguing the gold and silver clause, he wouldve had a better standing. |
